საქმიანობის სფერო ტურიზმი

კანონმდებლობა საქართველოს კანონმდებლობა

შპს "თრეველფაი" (შემდგომ — "კომპანია") წარმოადგენს ტურისტული მომსახურების გამწევ კომპანიას. წინამდებარე დოკუმენტი განსაზღვრავს კომპანიასა და მომხმარებელს შორის ურთიერთობის სავაჭრო პოლიტიკასა და პირობებს.

2. მომსახურების სფერო

კომპანია გთავაზობთ შემდეგი ტიპის ტურისტულ მომსახურებას:

• საერთაშორისო და ადგილობრივი ტურისტული პაკეტების შექმნა და განხორციელება

• ავიაბილეთების დაჯავშნა და მოწყობა

• სასტუმროების დაჯავშნა (სხვადასხვა კატეგორია)

• ტრანსფერის ორგანიზება (აეროპორტი — სასტუმრო — აეროპორტი)

• ექსკურსიებისა და ვიზიტების ორგანიზება

• ვიზის გაფორმებაში კონსულტაცია და ხელშეწყობა

• ინდივიდუალური და ჯგუფური ტურების ორგანიზება

3. შეკვეთის განთავსება და ხელშეკრულება

3.1 შეკვეთის პროცედურა

ტურისტული პაკეტის შეძენა ხდება წინამდებარე წესებისა და პირობების, ასევე კომპანიასა და მომხმარებელს შორის გაფორმებული მომსახურების ხელშეკრულების საფუძველზე.

შეკვეთის განთავსებისთვის მომხმარებელი ვალდებულია:

• კომპანიის წარმომადგენელს მიაწოდოს ყველა ტურისტის სახელი, გვარი, პასპორტის სერია/ნომერი, დაბადების თარიღი და მოქალაქეობა;

• ხელი მოაწეროს მომსახურების ხელშეკრულებას;

• ხელშეკრულების ხელმოწერის დღეს სრულად გადაიხადოს პაკეტის ღირებულება.

3.2 ხელშეკრულება

მომსახურება წარმოებს მხოლოდ კომპანიასა და მომხმარებელს შორის გაფორმებული წერილობითი ხელშეკრულების საფუძველზე. ხელშეკრულება შედგება ქართულ ენაზე, ორ ეგზემპლარად.

4. ღირებულება და გადახდა

4.1 ფასწარმოქმნა

ტურისტული პაკეტის ღირებულება მოიცავს ყველა გადასახადს და მითითებულია ლარში.

4.2 გადახდის წესი

პაკეტის სრული ღირებულება გადაიხდება ხელშეკრულების ხელმოწერის დღეს. გადახდა შესაძლებელია:

• ბანკში ჩარიცხვით — სს "თიბისი ბანკი", ანგ. # GE53TB7626736080100009

• ბანკში ჩარიცხვით — სს "საქართველოს ბანკი", ანგ. # GE53BG0000000162482713

გადახდის მნიშვნელოვანი პირობა

თუ მომხმარებელი ხელშეკრულების ხელმოწერის დღეს სრულ თანხას არ გადაიხდის, კომპანიას მის მიმართ არანაირი ვალდებულება არ წარმოეშობა და ტური არ განხორციელდება.

მომხმარებლის მიერ ხელშეკრულებით გათვალისწინებული მომსახურების ღირებულების გადახდა ნიშნავს რომ კომპანია გადახდის დღესვე იწყებს ხელშეკრულებით გათვალისწინებული მომსახურების შესრულებას.

5. ხელშეკრულების შეწყვეტა და გაუქმება

5.1 ხელშეკრულებაზე უარის თქმის დაუშვებლობა

მომხმარებელს უფლება არ აქვს უარი თქვას ხელშეკრულებაზე, შესაბამისად მას არ აქვს უფლება მოითხოვოს კომპანიისგან მომსახურების გაწევის მიზნით გადახდილი თანხები.

5.2 ხელშეკრულების შეწყვეტა

მომხარებელს ნებისმიერ დროს შეუძლია უარი თქვას მომსახურებაზე კომპენსაციის მოთხოვნის გარეშე.

5.3 ფორს-მაჟორი

ფორს-მაჟორული გარემოებების (სტიქიური უბედურება, საომარი მოქმედება, პანდემია, სამთავრობო შეზღუდვა) შემთხვევაში, თუ ეს პირდაპირ გავლენას ახდენს სადანიშნულო ადგილზე მგზავრობაზე:

• თუ შეყოვნება 2 კვირას არ აღემატება — ტურის გადადება შესაძლებელია ურთიერთშეთანხმებით;

• თუ შეყოვნება 2 კვირას აჭარბებს — ნებისმიერ მხარეს შეუძლია ხელშეკრულება შეწყვიტოს; კომპანია ვალდებულია გაწეული ხარჯების გამოკლებით დაუბრუნოს თანხა.

5.4 კომპანიის ინიციატივით გაუქმება

თუ კომპანია ფორს-მაჟორის გარეშე წყვეტს ხელშეკრულებას, ვალდებულია 14 კალენდარული დღის ვადაში სრულად დაუბრუნოს მომხმარებელს გადახდილი თანხა.

6. მომსახურების პირობების ცვლილება

6.1 უმნიშვნელო ცვლილება

კომპანიას უფლება აქვს, კომპანიისგან დამოუკიდებელი მიზეზებით (ავიაკომპანიის, სასტუმროს ან სხვა მომსახურების გამწევის გადაწყვეტილება), ცალმხრივად შეიტანოს უმნიშვნელო ცვლილებები, მათ შორის, სასტუმროს ოთახის კატეგორიაში, ფრენის დროში ან ტრანსფერის მარშრუტში. კომპანია ვალდებულია ამ ცვლილების შესახებ წერილობით აცნობოს მომხმარებელს.

6.2 მნიშვნელოვანი ცვლილება

მნიშვნელოვან ცვლილებად ჩაითვლება:

• გამგზავრების თარიღის 24 საათზე მეტით ცვლილება.

მნიშვნელოვანი ცვლილების შემთხვევაში მომხმარებელს უფლება აქვს, 3 კალენდარული დღის ვადაში:

• დაეთანხმოს ცვლილებას; ან

• შეწყვიტოს ხელშეკრულება კომპანიის მიერ გაწეული ხარჯების გამოკლებით.

დუმილი — თანხმობა

თუ მომხმარებელი 3-დღიანი ვადის განმავლობაში პასუხს არ გასცემს, ეს ჩაითვლება ცვლილებაზე თანხმობად.

7. მომხმარებლის ვალდებულებები

მომხმარებელი/ტურისტი ვალდებულია:

• გამგზავრებამდე სულ მცირე 14 კალენდარული დღით ადრე კომპანიას მიაწოდოს ყველა ტურისტის პასპორტის ასლი;

• დარწმუნდეს, რომ მის პასპორტს გამგზავრების დღიდან სულ მცირე 6 თვის ვადა აქვს;

• პასუხისმგებლობა აიღოს ვიზისა და სხვა სამოგზაურო დოკუმენტების გაფორმებაზე (კომპანია ეხმარება, მაგრამ საბოლოო პასუხისმგებლობა მომხმარებელს ეკისრება);

• გამგზავრებამდე გაეცნოს სადანიშნულო ქვეყნის შესასვლელ მოთხოვნებს (ვიზა, ჯანმრთელობის სერტიფიკატი და სხვ.);

• სასტუმროს ქცევის წესებს და ადგილობრივ კანონმდებლობას დაიცვას;

• ნებისმიერი პრეტენზია მოგზაურობის დროს დაუყოვნებლივ, ხოლო დაბრუნების შემდეგ — 3 კალენდარული დღის ვადაში წარუდგინოს კომპანიას.

8. კომპანიის პასუხისმგებლობა და გამონაკლისები

8.1 კომპანიის პასუხისმგებლობა

კომპანია პასუხისმგებელია ხელშეკრულებით გათვალისწინებული მომსახურების სათანადო შესრულებაზე, თუმცა კომპანიას პასუხისმგებლობა ვერ დაეკისრება მესამე პირების ბრალეულ ქმედებაზე. ასეთ შემთხვევაში კომპანია იღებს ვალდებულებას რომ დაკვეთს/ტურისტს გაუწიოს შესაბამისი საკომუნიკაციო დახმარება მესამე პირების მიერ მიყენებულ ზიანზე.

8.2 გამონაკლისები

კომპანია პასუხს არ აგებს:

• ვიზის, პასპორტის ან სხვა ოფიციალური დოკუმენტის არარსებობის ან ვადაგასვლის გამო მომსახურების ვერ მიღებაზე;

• საბაჟო, სასაზღვრო ან საკარანტინო ორგანოების ქმედებებზე;

• სადაზღვევო კომპანიის მოქმედებაზე ან უმოქმედობაზე;

• ნებისმიერ შედეგზე, რომელიც კომპანიის ბრალით არ დამდგარა;

• ტურისტის მიერ ნებაყოფლობით მომსახურების მიუღებლობაზე, თუ ეს მომსახურება ხელმისაწვდომი იყო.

9. პრეტენზიები და დავების გადაწყვეტა

ნებისმიერი პრეტენზიის შემთხვევაში მომხმარებელი ვალდებულია:

• მოგზაურობის დროს — დაუყოვნებლივ აცნობოს კომპანიის წარმომადგენელს;

• დაბრუნების შემდეგ — 3 კალენდარული დღის ვადაში წერილობით (ელ-ფოსტით: info@travelfy.ge) წარუდგინოს პრეტენზია კომპანიას.

კომპანია ვალდებულია პრეტენზია განიხილოს 30 კალენდარული დღის ვადაში. შეუთანხმებლობის შემთხვევაში დავა გადაიწყვეტება თბილისის საქალაქო სასამართლოში, საქართველოს კანონმდებლობის შესაბამისად.

მომხმარებლის სამართლებრივი უფლებები

მომხმარებელს დამატებით შეუძლია მიმართოს საჯარო სამართლის იურიდიულ პირს — საქართველოს კონკურენციისა და მომხმარებლის დაცვის სააგენტოს.

10. პერსონალური მონაცემების დაცვა

კომპანია მომხმარებლის პერსონალურ მონაცემებს ამუშავებს „პერსონალურ მონაცემთა დაცვის შესახებ" საქართველოს კანონის შესაბამისად, მხოლოდ ტურისტული მომსახურების გაწევის მიზნებისთვის. მონაცემები არ გადაეცემა მესამე პირებს მომსახურების გაწევისთვის საჭირო მოცულობის გარეშე.

11. მოქმედი კანონმდებლობა

წინამდებარე წესები და პირობები ეფუძნება და შეესაბამება საქართველოს მოქმედ კანონმდებლობას.
